Mitnick Sentencing Delayed Again

Kevin Mitnick, the famous hacker who found himself on the wrong side of the law several times, has had his sentencing delayed from July 12th to July 26th.  The delay, granted by Judge Mariana Pfaelzer, came just after what seems to be the final motion in the case was filed by the defense.  The fifteen page motion is the final in a "never-ending" stream from both the prosecution and defense. 

The point of contention which has caused this latest delay seems to be the amount of damages and the restitution for those damages.  The government has repeatedly claimed damages to be anywhere from eighty to almost three hundred million dollars.  The defense, however, claims the damages should be set to no more than five thousand dollars.

Mitnick has been convicted of several crimes at this, the conclusion of his ridiculously long trial and pre-trial period.  The amount of time this has taken has raised the ire of many, including the staff of 2600, who have been spearheading the "Free Kevin" campaign.  In addition, the staff of OSAll feels that Mitnick has been punished enough for his crimes and should be released immediately.

Judge Pfaelzer, however, said that "he will be sentenced.  There will be restitution."
