Kevin Sent to San Bernardino

Kevin Mitnick has been moved from the Metropolitan Detention Center - Los Angeles, and is now incarcerated at the San Bernardino County Jail.

According to a source who prefers to remain unnamed, the federal government has a contract with the state of California to transfer prisoners awaiting sentencing to San Bernardino County Jail. The contract is an attempt to alleviate overcrowding at MDC-Los Angeles by transferring prisoners to the SB County Jail until the prisoner receives their final assignment to the prison where they will serve their sentence. That source also stated they have never seen a prisoner transferred "so quickly after their sentencing."

Kevin observes kosher dietary laws. The SB County Jail is either unable or unwilling to provide kosher food, and so Kevin hasn't eaten since his transfer out of MDC-L.A. at 4:30 p.m. on Wednesday, August 11, 1999.

During Kevin's sentencing hearing on Monday, August 9th, attorney Don Randolph specifically asked the court to keep Kevin in MDC-Los Angeles for several reasons, including the need to conclude their review of the electronic evidence using a laptop computer as well as the fact that MDC permits Kevin to practice his religion, which includes observing kosher dietary laws.

Judge Pfaelzer responded by telling attorney Don Randolph that Kevin Mitnick had a "constitutional right" to practice the religion of his choice, and to have food consistent with his religion. Judge Pfaelzer also indicated her confusion about the issue, saying "this is the first I've heard of this," and that attorney Randolph had not provided any motion on the matter. Note that the judge's comment failed to mention her specific direction to attorney Randolph that he file only a single motion prior to the sentencing hearing on August 9, 1999.

freekevin.com has learned that a motion will be filed with the court on August 12 seeking Kevin's immediate return to MDC-L.A. for the reasons mentioned above. More details will be posted as they become available.
