Mitnick Sentenced

Kevin Mitnick has been sentenced.
U.S. District Judge Mariana Pfaelzer sentenced Mitnick, who has been in jail for various hacking charges since February 1995, to 45 months incarceration and $4,125 in restitution -- less than the $1.5 million sought by the government. In addition, Mitnick will be forbidden from using computers for a period of three years -- although Judge Pfaelzer said he couldn´t be properly monitored.
Judge Pfaelzer showed her bias in saying the restitution was "token" compared to the "damage inflicted" on companies hacked by Mitnick. She said "I want to make a restitution order which is much, much larger."
Mitnick´s lawyer asked that he be officially ordered to attend a 12-step program for computer addiction. The judge denied the request, however, without much comment. She had sentenced him to a 12-step program in an earlier 1989 case.
Mitnick is expected to get credit for time served at some point in the next year -- at which point he will probably be released. Many industry prognosticators had expected him to released to a half-way house, but Judge Pfaelzer didn´t see it that way.
